Terms and Conditions for CathChan
Please read these Terms and Conditions carefully before purchasing any coaching services offered by Cath Chan (“we”, “us”, or “our”). By purchasing our services, you agree to be bound by these Terms and Conditions.
1. SERVICES PROVIDED
a. Coaching Services: The term “coaching” in this agreement encompasses life coaching, personal development coaching, confidence and self-esteem coaching, and executive coaching, as applicable. These services are individually tailored to address the specific needs and goals of each client, offering personalised guidance, strategies, and support to foster personal growth and achievement.
b. No Guarantees: While we strive to provide high-quality services, we do not guarantee specific outcomes or results. Success is dependent on various factors including your personal efforts and engagement in the coaching process.
2. PURCHASING AND PAYMENT
a. Offers and Confirmation: By purchasing our coaching packages, you are making an offer to buy the service. A contract will be created when we send you a confirmation email of your booking and receive the payment as agreed.
b. Payment Plans: All coaching services are payable in full prior to the commencement of the coaching programme unless otherwise agreed in writing. Payment options may be available on a case-by-case basis, and any alternative arrangements must be discussed and confirmed in advance. Failure to make timely payments may result in the termination of services.
c. Refunds: Due to the personalised nature of coaching services, we do not offer refunds once coaching has commenced. If you are unsatisfied with the service, we encourage you to discuss your concerns with us to seek resolution.
3. CONFIDENTIALITY
a. Confidentiality Commitment: We respect your privacy and confidentiality. All personal information shared during coaching sessions will be kept confidential, except where disclosure is required by law or with your explicit consent.
b. Non-Disclosure: You agree to maintain the confidentiality of any personal information shared by other participants during group coaching sessions, if such sessions are offered.
4. RESPONSIBILITIES AND LIABILITIES
a. Your Responsibilities: The coaching process is collaborative. You are responsible for attending sessions, completing any agreed tasks or assignments, and actively engaging in the process.
b. No Professional Advice: Our services are for personal development and coaching purposes only and are not a substitute for professional legal, financial, or mental health advice. We advise seeking professional advice when appropriate.
c. Limitation of Liability: We are not liable for any direct, indirect, or consequential damages that may result from your use of our services. Our liability is limited to the cost of the service you have paid for.
5. INTELLECTUAL PROPERTY
a. Ownership: All materials provided during the coaching sessions (workbooks, resources, etc.) remain the intellectual property of Cath Chan.
b. Usage: You may not share, copy, distribute, or reproduce any materials without our prior written consent. These materials are provided for your personal use only.
6. TERMINATION
a. Termination by Us: We reserve the right to terminate the coaching relationship if payment is not received on time, if you violate these terms, or if there is a breach of trust. In such cases, no refund will be given for services already provided.
b. Termination by You: If you wish to terminate the coaching relationship, you must provide at least 7 days’ notice before your next session. In such cases, refunds may be considered at our discretion for any services not yet delivered.
7. CHANGES TO TERMS
a. Right to Amend: We reserve the right to update or amend these Terms and Conditions at any time to reflect changes in our services, market conditions, or legal requirements. Your continued use of our services constitutes acceptance of the updated terms.
8. DISPUTE RESOLUTION
a. Mediation: In the event of a dispute, we encourage an initial effort to resolve the issue amicably through discussion. If a resolution cannot be reached, both parties agree to submit to mediation before pursuing any further legal action.
9. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of Singapore. Any disputes will be subject to the exclusive jurisdiction of the courts in Singapore.
